Here is the law about proving economic damages.

Specifically proving future economic damages: Be aware that many jurisdictions require you, as the plaintiff, to present sufficient evidence of future economic damages so that a jury can calculate those expenses with reasonable certainty. Some cases, like Truelove v. Bount, 954 So. 2d 1284, 1288 (Fla. 2d DCA 2007), have turned the case for economic damages into a financial inquiry, interesting only to accountants and bean counters. For medical expenses, for example, that requires specific testimony as to how often each particular type of medical treatment will be needed in the future and the cost of that treatment. Generalities and guesses aren’t good enough.

Also, it’s best that the expert giving this testimony use the buzz phrase preferred in your jurisdiction. In Florida, that’s “reasonable certainty,” not “reasonable probability” and other arguable less certain-sounding phrases. But, if the issue comes up, consider arguing that certainty is not required for proving damages. Instead, the burden of proof is the same that applies to the other questions presented to the jury. For most (all?) states, that’s the greater weight of the evidence. See, e.g., Fasani v. Kowalski, 43 So. 3d 805, 812 (Fla. 3d DCA 2010) (holding “[I]t is plaintiff’s burden to establish that future medical expenses will more probably than not be incurred.”); Montesinos v. Zapata, 43 So. 3d 97, 99 (Fla. 3d DCA 2010) (same); Kloster Cruise Ltd. v. Grubbs, 762 So. 2d 552, 556 (Fla. 3d DCA 2000) (holding that plaintiff has burden to show that future medical expenses will more probably than not be incurred). In fact, Florida’s supreme court has held that it is not necessary for a medical expert to testify at all. Sullivan v. Price, 386 So. 2d 241, 244 (Fla. 1980).
